Disrupted supply chains have severely impacted the economy in recent years. There is still no all-clear. MTR Legal Rechtsanwälte advises companies on all questions related to supply chains.

The Corona pandemic, the consequences of the Ukraine war, and other crises have caused disrupted international supply chains and hit many companies hard. The economy faces the challenge of making supply chains more resilient to global crises. Furthermore, companies must continue to prepare for potential supply shortages and take measures to be able to respond to such crises. The situation has somewhat relaxed, but an all-clear cannot be given, says attorney Michael Rainer, MTR Legal Rechtsanwälte.

According to a study by the Capgemini Research Institute, 89 percent of companies surveyed in November and December 2022 consider disrupted supply chains to be the greatest risk to business growth. This risk is deemed even higher than high energy prices. According to the survey, 43 percent of companies plan investments to better position themselves against disrupted supply chains.

In Germany, according to a survey by the ifo Institute, companies have increasingly relied on inventory management to prepare for supply shortages. Additionally, the circle of suppliers has been expanded, supply chains are better monitored, or supplier parts are manufactured in-house.

Disrupted supply chains lead to legal consequences in addition to production delays and revenue losses. To protect against this, a bundle of legal measures can be taken. If the damage has already occurred, it must be clarified which national law applies in the case. Then it must be examined what rights and obligations arise from the contract and what legal consequences a breach of contract entails. Furthermore, it must be clarified whether the contracting partner can invoke force majeure that is decisive for the difficulties.

Additionally, preventive measures should be taken within the company to prepare for performance disruptions.
